Privacy Policy. If you do not agree, please refrain from using the
website. We may revise these Terms at any time without notice, and it is your responsibility to review the most current

2. Copyright and Trademark InformationAll content on this website, including text, images, graphics, logos, and designs, is the intellectual property of Her Higher Standard unless otherwise stated. You may not reproduce, copy, or use any part of this content without express written permission from the Company. All trademarks, logos, and service marks displayed on this website are the property of the Company or third parties, and you are not permitted to use them without prior written consent.
3. OwnershipAll website templates and designs created by Her Higher Standard remain the intellectual property of the Company. Clients are granted a non-exclusive license to use the final deliverables for their business upon full payment.
Please note that Her Higher Standard retains the right to modify and reuse any website templates or designs for other clients or for sale as pre-made templates. These modifications will include replacing all branded or licensed text, photography, and assets to ensure that the design is not identical to your version. By using our services, you acknowledge and agree that the website design or template used for your project may be modified and repurposed in this way.
Website Templates & Semi-Custom Brand KitsOne purchase of a website template grants usage for one website. If you wish to use the same template for multiple sites, you must purchase a new license for each use. Sharing, distributing, or repurposing templates across multiple websites is strictly prohibited and constitutes a violation of these Terms, subject to legal action.
Template purchases grant you the right to utilize any custom AI stock photography or Google Fonts included in the template for your website only. Use of these assets outside of your website (including but not limited to social media, packaging, or print materials) is not permitted under this license.
Due to the digital and instant access nature of the templates, all sales are final and non-refundable.
Each semi-custom brand kit is only available for purchase up to four times, then permanently retired. Availability is on a first-come, first-served basis. After purchasing a kit, customization may take up to three months depending on our availability.
Each semi-custom brand kit includes one round of revisions. Any additional revisions will be billed at $100 per round. If the Designer concludes that additional revisions fall outside the scope of the semi-custom package, they reserve the right to decline or propose an upgrade to the full Brand Identity package.
All semi-custom brand kit purchases are final and non-refundable.
4. Conduct and Use of WebsiteYou agree to use the website solely for lawful purposes. You may not use the website:
- In any way that violates local, national, or international law or regulation.
- In any manner that is unlawful, fraudulent, or has any unlawful or fraudulent purpose or effect.
- To transmit any harmful or malicious software (e.g., viruses, Trojan horses, spyware).
- To reproduce, copy, or resell any part of our website or its content without prior written permission.
5. Intellectual Property Use and Ownership
You acknowledge and agree that:
(a) Each product and service marketed on this Site is made available solely for license, not sale, to you and other prospective customers under the terms, conditions, and restrictions of the license agreement posted with/made available to you through a link accompanying the description of that specific product or service.
(b) You will comply with all terms and conditions of the specific license agreement for any product or service you obtain through this Site, including, but not limited to, all confidentiality obligations and restrictions on resale, use, reverse engineering, copying, making, modifying, improving, sublicensing and transfer of those licensed products and services. You will not cause, induce or permit others' noncompliance with the terms and conditions of any of these product and service license agreements.
(c) Her Higher Standard Design Studio is and will remain the sole and exclusive owner of all intellectual property rights in and to each product and service made available on this Site and any related specifications, instructions, documentation or other materials, including, but not limited to, all related copyrights, patents, and trademarks and other intellectual property rights, subject only to the limited license granted under the product's or service's license agreement. You do not and will not have or acquire any ownership of these intellectual property rights in or to the products or services made available through this Site, or of any intellectual property rights relating to those products or services.
6. Intellectual Property Infringement Claims
The Parties expressly agree and understand that the Customer shall have the sole responsibility for ensuring that any trademark(s), logo(s), or brand name(s) used within the Client’s website or brand kit do not infringe upon any third-party intellectual property rights. The Customer knowingly assumes all risk of using such elements.
In the event of a third-party claim regarding intellectual property infringement, the Client agrees to indemnify, save, and hold harmless Her Higher Standard from any and all damages, liabilities, costs, losses, or expenses arising out of such claim. This includes any situation arising from the Customer’s failure to obtain proper intellectual property clearance or permissions.
7. Returns and Refunds
WE OFFER NO REFUNDS ON ANY PRODUCTS DESIGNATED AS NON-RETURNABLE INCLUDING BUT NOT LIMITED TO ALL WEBSITE TEMPLATES, SEMI-CUSTOM BRAND KITS, OR ANY OTHER INTANGIBLE DIGITAL PRODUCTS. ALL SALES ARE FINAL.
Due to the digital nature of our offerings and instant access delivery, you expressly agree that purchases made from Her Higher Standard are not eligible for returns, refunds, or exchanges.
8. LiabilityHer Higher Standard provides services and information on the website "as is," without any guarantees, conditions, or warranties regarding the accuracy or completeness of the information provided. We disclaim all liability arising from your use of the website or services, including but not limited to:
- Loss of income or revenue.
- Loss of business.
- Loss of profits or contracts.
- Loss of anticipated savings.
- Loss of data.
- Loss of goodwill.
- Wasted management or office time.
- Any indirect, special, or consequential loss or damage arising from your use of the website, services, or
inability to access the website.
In no event shall our liability exceed $50. Access to and use of the website is at your own risk, and you will be solely responsible for any damage to your device or loss of data.9. Dispute ResolutionAny disputes arising out of or relating to these Terms or your use of the website and services will be resolved through binding arbitration, rather than in court. Arbitration is a less formal method of dispute resolution and involves a neutral arbitrator rather than a judge or jury. The decision of the arbitrator is final and binding.
By agreeing to these Terms, you waive the right to a trial by jury or to participate in a class action lawsuit. Arbitration shall be conducted through a mutually agreed-upon arbitration service, and any costs related to the arbitration will be split equally between the parties. All claims must be brought individually and not consolidated with any claims of other parties.
10. Revisions, Ownership, and Client Responsibilities
- Revisions Each project includes a set number of revisions,
as outlined in the project proposal. Any revisions beyond the agreed scope may incur additional fees.
- Ownership All content created by Her Higher Standard
remains the intellectual property of the Company until full payment is received. Upon full payment, you are
granted a non-exclusive license to use the final deliverables for your business.
- Client Responsibilities Clients must provide all necessary
materials, feedback, and approvals in a timely manner to ensure smooth project progression. Delays in providing
these materials may extend the project timeline.
11. Payment TermsPayment terms for services will be outlined in your project proposal. Late payments may result in delays in service delivery or contract termination. Clients are responsible for making payments according to the agreed-upon schedule.
12. IndemnificationYou agree to indemnify, defend, and hold Her Higher Standard, its affiliates, officers, directors, agents, contractors, and employees harmless from any claim, demand, or damages, including reasonable attorneys’ fees, arising out of your use of the website or services, breach of these Terms, or violation of any law or the rights of a third party.
13. SeverabilityIf any provision of these Terms is found to be unlawful, void, or unenforceable, such provision shall be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
14. Changes to TermsWe reserve the right to update or change these Terms at any time. Any changes will be effective immediately upon posting on the website. It is your responsibility to review the Terms periodically for updates. Continued use of the website after any changes constitutes acceptance of those changes.
